Our Flexible Packages

We understand that one size doesn’t fit all when it comes to your required leasing services, which is why we offer a flexible array of fixed fee packages as follows:

Drafting the Lease


Included

  • Taking your instructions regarding the terms to be included in the Lease;
  • Drafting the Lease based upon your instructions and providing you with the final Lease;
  • Answering any queries you may have regarding the Lease;
  • Providing the final Lease to both you and the Lessee with signing instructions; and
  • Advice for you to decide whether it is necessary to obtain the consent of your bank/mortgagee to the Lease and to register the Lease at the Titles Office (if upon such advice you wish to proceed to do these, please note our fees for mortgagee consent and Lease registration).

** A service fee of 1.75% of professional fees is in addition to these fees.

Not Included

  • Negotiating or advising on the terms of any Letter of Offer;
  • Negotiations between the parties regarding the Lease terms (see separate category);
  • Preparation of the Lessor Disclosure Statement for a retail lease (see separate category);
  • Obtaining the Lessor’s bank’s consent or any other consent to the Lease (see separate category); or
  • Registering the Lease at the Titles Office (see separate category).

Obtaining mortgagee consent to the Lease


Included

  • Drafting the application to your mortgagee for consent to the Lease along with the Form 18 Consent document;
  • Liaising with your mortgagee to facilitate obtaining consent; and
  • Reviewing and advising you on the mortgagee’s Deed of Entry document in the event that the mortgagee requires this be signed.

** A service fee of 1.75% of professional fees is in addition to these fees.

Not Included

  • Note that your mortgagee may charge you a fee to consider your application for mortgagee consent, commonly in the range of $150 – $300. The Lease may allow you to pass on this cost to the Lessee; or
  • Negotiations to any Deed of Entry from your mortgagee (if applicable).

Registering the Lease at the Titles Office


Included

  • Liaising with you regarding the requirements for registration, including the Titles Office fee and any ancillary documents such as the mortgagee consent and trust deed etc;
  • Checking compliance of all documents with the Titles Office requirements; and
  • Lodging the Lease and documents for registration at the Titles Office and providing you with registration confirmation when received.

** A service fee of 1.75% of professional fees is in addition to these fees.

Not Included

  • If a plan of the premises is required, you must liaise with your surveyor to have that plan prepared. The Lease may allow you to pass on this cost to the Lessee; and
  • A fee will be payable to the Titles Office to register the Lease. The Lease may allow you to pass on this cost to the Lessee.

Drafting Special Clauses to the Lease


Included

  • Drafting a special clause that is not ordinarily contained within a Lease as standard practice –  such as: first right of refusal for the Lessee to purchase the premises; rent or fitout concession; requirement on Lessor or Lessee to undertake works;
  • Taking instructions from you as to the details and intended effect of the special clause; and
  • Drafting the special clause and incorporating this in context into the Lease.

** A service fee of 1.75% of professional fees is in addition to these fees.

Not Included

  • Extremely complex or convoluted special clauses (we can provide a specific quote for such complex matters);
  • The fee is calculated per special clause. If there are multiple special clauses required, then the fee will apply to each special clause.

Negotiations to the Lease with the Lessee (10 or less requested changes)


Example: Advising on and responding to 18 changes requested by the Lessee in one round would be $700 plus GST

Included

  • Advising on the effect and any risks of each amendment requested by the Lessee;
  • Recommendations regarding the requested amendment and any other options of comprise;
  • Taking your instructions as to whether or not you agree to each amendment;
  • Responding to the Lessee in respect of each requested amendment; and
  • Drafting amendments to the Lease to incorporate agreed amendments – except if the amendment relates to drafting a new clause rather than amending an existing clause.

** A service fee of 1.75% of professional fees is in addition to these fees.

Not Included

  • Drafting new special clauses that result from the negotiations other than amendments to existing clauses;
  • The fee block relates to amendments in a single round of negotiations. For multiple rounds of negotiations, the fee block will relate to each round;
  • If amendments are drafted to the Lease and the Lessee requests further amendments to the wording, this is a further requested amendment by the Lessee.

Negotiations to the Lease with the Lessee (For more than 10 requested changes)


Example: Advising on and responding to 18 changes requested by the Lessee in one round would be $700 plus GST

Included

  • Recommendations regarding the requested amendment and any other options of comprise;
  • Taking your instructions as to whether or not you agree to each amendment;
  • Responding to the Lessee in respect of each requested amendment; and

Not Included

Drafting the Lessor Disclosure Statement (if retail)


Included

  • Taking your instructions regarding the information to be included in the Lessor Disclosure Statement;
  • Drafting the Lessor Disclosure Statement; and
  • Issuing the signed Lessor Disclosure Statement to the Lessee.

** A service fee of 1.75% of professional fees is in addition to these fees.

Not Included

  • Calculating outgoings estimates.
